ATB Agreements

We’re updating the following ATB Agreements: i) ATB Financial Personal Account Agreement ii) ATB Personal Terms and Conditions iii) ATB Business Banking Account Agreement iv) ATB Business Solutions Agreement - Single Administrator and ATB Business Solutions Agreement - Multiple Administrator and v) Electronic Dealing Agreement for ATB FX. These ATB Agreements apply to one or more ATB products or services you use. This page provides a summary of the most notable updates to these ATB Agreements.

The updates to all ATB Agreements will take effect on November 16, 2023. If you continue to use our products and services on or after November 16, 2023, you are agreeing to the updated ATB Agreements.

Retail:

ATB Financial Personal Account Agreement (formerly the Little Book of Account Info)

  • This Agreement is now called the ATB Financial Personal Account Agreement.
  • We’ve clarified the limits on your Debit Card.
  • We’ve clarified how transactions (withdrawals, purchases) are processed if your Debit Card has a Visa logo on the front, and if your Debit Card does not have a Visa logo on the front.
  • ATB Visa Debit Cards will be enabled for contactless payments at merchant terminals outside of Canada.
  • We’ve added information about your responsibility to keep your Debit Card, PIN, and other sensitive information safe, secure and confidential.
  • We’ve clarified our terms regarding unauthorized transactions.
  • We’ve clarified the types of transactions covered by the Interac Zero Liability Policy.
  • We’ve added information about fraud, fake websites, and email and mobile device takeovers:
    • That outlines your responsibilities to keep up to date on fraud education.
    • We’ve explained that if you click on a link, email or use third party websites and you suffer a loss, you are liable for such loss.
  • We’ve added a new section called Funds Transfers:
    • You may send and/or receive Funds Transfers (for example, wire transfers, Interac e-Transfers).
    • You are prohibited from sending or receiving Funds Transfers with messages that contain malicious content.
    • ATB has the right to reject and/or return a Funds Transfer if: malicious content is transmitted in the message accompanying the Funds Transfer; the Funds Transfer is being sent to or originated from a sanctioned country; if there are errors in the Funds Transfer or the Funds Transfer is fraudulent, or if the Funds Transfer doesn’t comply with our terms.
    • You are to practice caution when viewing any messages accompanying Funds Transfers and acting on the contents of the message.
    • ATB bears no responsibility for the contents of any messages accompanying Funds Transfers.
    • ATB isn’t liable even if a Funds Transfer was processed that resulted in malicious content being transmitted.
    • You indemnify ATB for any claims arising in connection with Funds Transfers.
  • We’ve added a new section about Trust Accounts:
    • For accounts held by certain trusts, the trust must, on an annual basis, notify ATB if any discretionary beneficiaries receive a distribution from the account during the year. This is to enable ATB to report to the Canada Revenue Agency as required under the Foreign Account Tax Compliance Act.
  • We’ve added a new section about Other Service Providers
  • If you open an account with a person under 20, we’ve clarified that you are responsible for all activities and actions conducted on the account by such person under 20.
  • We’ve clarified our process for inactive accounts.

ATB Personal Terms and Conditions

  • We’ve explained the circumstances when ATB may decline to act, and has the right to decline to act, on any instructions made through ATB Personal, and is not liable for declining to act on such instructions.
  • We’ve clarified your responsibility to ensure valid and timely instructions are provided to ATB, and where applicable, to ensure sufficient funds are in your accounts for various services.
  • In the Interac e-Transfer section:In the Interac e-Transfer section:
    • We’ve explained how you may receive Interac e-Transfers by providing your email, mobile number, or account number to the sender.
    • You are prohibited from sending or receiving Interac e-Transfers with messages that contain malicious content.
    • If malicious content is transmitted in the message accompanying the Interac e-Transfer, Interac Corp. has the right to:remove all or a portion of the message from the Interac e-Transfer before processing it , or not process the Interac e-Transfer altogether.
    • If ATB is informed of or is otherwise aware of malicious content transmitted in the message accompanying the Interac e-Transfer, ATB may notify Interac Corp.
    • ATB bears no responsibility for the contents of any messages accompanying Interac e-Transfers.
    • ATB isn’t liable even if an Interac e-Transfers was processed that resulted in malicious content being transmitted.
    • You indemnify ATB for any claims arising in connection with Interac e-Transfers.
  • We’ve changed the name of the section “ATB.com Digital Product Acquisition” to “Online Product Acquisition”. In this section we’ve explained we may use your personal information to pre-populate any fields in online applications you submit for ATB products or services.
  • We’ve clarified our software license terms.
  • We’ve reiterated your responsibilities to implement security procedures and controls to protect your Passcode and other sensitive information.
  • We’ve explained that if you click on a link, email or use third party websites and you suffer a loss, you are liable for such loss.

Business:

ATB Business Banking Account Agreement

  • We’ve added information about your responsibility to keep your Debit Card, PIN, and other sensitive information safe, secure and confidential.
  • We’ve added a new section called Funds Transfers:
    • You may send and/or receive Funds Transfers (for example, wire transfers, Interac e-Transfers).

    • You are to practice caution when viewing any messages accompanying Funds Transfers and acting on the contents of the message.
    • ATB bears no responsibility for the contents of any messages accompanying Funds Transfers.
    • ATB isn’t liable even if a Funds Transfer was processed that resulted in malicious content being transmitted.
    • You indemnify ATB for any claims arising in connection with Funds Transfers.
  • We’ve added a new section called Trust Accounts:

  • In the section Changes to Interest Rate, we’ve explained that where the interest rate is based on a published reference rate which is no longer available, the interest rate shall be set by ATB using an alternate benchmark rate that ATB reasonably concludes is comparable to the initial published rate.
  • We’ve expanded the Privacy Notice section to make it easier for you to understand how we handle your personal information.

ATB Business Solutions Agreement (Single Administrator (Form 1377) and Multiple Administrator (Form 1378))

  • We remind you to:
    • Keep your security credentials (MFA passcodes, login IDs, passwords) safe, secure and confidential.
    • Exercise caution when transacting through ATB Business given the prevalence of fraud.
    • Keep up to date on fraud education.
  • You are responsible if you use account aggregation services.
  • We’ve explained the circumstances when ATB may decline to act, and has the right to decline to act, on any instructions made through ATB Business, and is not liable for declining to act on such instructions.
  • We’ve added a new section called Funds Transfers:

    • ATB isn’t liable even if a Funds Transfer was processed that resulted in malicious content being transmitted.
    • You indemnify ATB for any claims arising in connection with Funds Transfers.
  • If you act as an Agent for an Account Holder, you are responsible to comply with all obligations and agreements associated with being an Agent.

Electronic Dealing Agreement

  • In Schedule B Wire Transfer Schedule:
    • We’ve added new terms about wire transfers:
      • You are prohibited from sending wire transfers with messages that contain malicious content.
      • ATB has the right to reject and/or return a wire transfer if: malicious content is transmitted in the message accompanying the wire transfer; the wire transfer is being sent to or originated from a sanctioned country; if there are errors in the wire transfer or the wire transfer is fraudulent, or if the wire transfer doesn’t comply with our terms.
      • ATB bears no responsibility for the contents of any messages accompanying wire transfers.
      • ATB isn’t liable even if a wire transfer was processed that resulted in malicious content being transmitted.
